Colorado's Family and Medical Leave Insurance (FAMLI) Division is conducting rulemaking as we build a system that works for both employers and workers. Below you’ll find information on our upcoming public hearings, all adopted rules, copies of current and previously proposed rules, recordings from previous rulemaking hearings, public comments received as well as the FAMLI Statute.

Upcoming Public Hearing on October 17, 2023:
This hearing will cover amendments to the following regulations and new regulation:
- 7 CCR 1107-3: Regulations Concerning Benefits and Employer Participation Requirements
- 7 CCR 1107-4: Regulations Concerning Coordination of Benefits and Reimbursement of Advance Payments
- 7 CCR 1107-5: Regulations Concerning Private Plans
- 7 CCR 1107-6: Regulations Concerning Program Integrity
- 7 CCR 1107-7: Regulations Concerning Employee Job Protection, Anti-Retaliation, and Anti-Interference
- 7 CCR 1107-8: Regulations Concerning Investigations
- 7 CCR 1107-9: Regulations Concerning Appeals
The FAMLI Division will host a rulemaking public hearing on Tuesday, October 17, 2023 beginning at 4:30 p.m. and ending once the last person who wishes to speak has been heard.
This hearing will cover multiple sets of rules and will be held virtually over Zoom. Copies of the proposed rules are listed in the table below. Registration is required, and we strongly encourage attendees to RSVP and let us know they plan to testify by filling out this form. Anyone may submit comments to the FAMLI Division regarding any proposed or adopted rules at any time. Please submit your comments by filling out our public comment form here. Submitted comments will be considered formal comments and may be displayed publicly. All comments submitted either at the virtual rulemaking hearing or written and submitted to the Division online carry the same weight and will be considered by the Division for inclusion in subsequent rule changes. The comment period for the rules on 7 CCR 1107-3 through 1107-9, will close on Wednesday, October 18, 2023 at 9:00 a.m.

Important Updates
State Average Weekly Wage Update: Effective July 1, 2023, At 12:01 a.m., the state average weekly wage for the purposes of FAMLI benefits will be $1,421.16.
MAXIMUM BENEFIT: Pursuant to §8-13.3-506(1)(b), the maximum weekly benefit will remain $1,100.
WEEKLY BENEFITS: Pursuant to §8-13.3-506(1)(a), benefits for covered individuals shall be paid as follows:
- Average weekly wage less than or equal to $710.58 shall be replaced at a rate of 90%.
- Average weekly wage above $710.58 shall be replaced at a rate of 50%, up to the maximum benefit.
