Report FAMLI Noncompliance or Audit Issues

 Audits

The Family and Medical Leave Insurance (FAMLI) Audits Team ensures that businesses are following the law. The Audits Team performs audits to verify:

  • Accurate wages are reported for all workers, 
  • All workers are properly classified (Independent Contractor vs Employee), and
  • Employers are complying with all FAMLI payroll reporting rules and regulations.

If you want to report a business for wage or pay related issues or a situation of a misclassified worker, please complete the Audits Form.

 

 Compliance

The Compliance Team ensures employers are following all FAMLI statutes, rules, and regulations, including notice requirements, coordination of benefits, and private plan procedures. 

If you want to report a business for violations including, but not limited to:

  • Employers not posting FAMLI program notices on site or electronically to their employees, 
  • Employers not notifying employees of the FAMLI program and eligibility for FAMLI leave,
  • Employers requiring employees to use or exhaust their vacation or sick time prior to or while receiving FAMLI, and/or 
  • Employees having issues with private plan procedures/processes (examples: allegations that the plan is not equal to or better than FAMLI, no application process for applying for benefits or being denied benefits for a qualifying condition).
