Anyone may submit a public comment regarding these proposed rule changes. You can submit a public comment in writing by using our web form or in person at our upcoming public hearing. All comments will be equally considered whether submitted in writing or at the public hearing. The Division will accept public comments until 9 a.m. on October 16, 2025.

Adopted Rules Effective October 30, 2025

Amendments to the rules below were adopted on September 9, 2025, and will become effective on October 30, 2025.

Note: this rule may be further changed by amendments proposed above, and a final adopted version will be published on this website after any amendments are adopted.

Important Updates

State Average Weekly Wage Update: Effective July 1, 2025, at 12:01 a.m., the state average weekly wage for the purposes of FAMLI benefits is $1,534.94.

MAXIMUM BENEFIT: Pursuant to C.R.S. § 8-13.3-506(1)(b), the maximum weekly benefit amount is 90% of the state average weekly wage, which is $1,381.45 as of July 1, 2025. 
 
WEEKLY BENEFITS: Pursuant to C.R.S. § 8-13.3-506(1)(a), wage replacement benefits for covered individuals shall be paid as follows:

  • Any part of the worker's average weekly wage less than or equal to 50% of the state average weekly wage ($767.47) shall be replaced at a rate of 90%.
  • The rest of the worker's average weekly wage shall be replaced at a rate of 50%, up to the maximum benefit.
