Here’s what happens now if you got a 2023 employer premium refund

Colorado’s new Family and Medical Leave Insurance (FAMLI) program covers partial pay replacement for workers who need to temporarily step away from their jobs because of certain life events.

 

Employers and workers alike contribute to the insurance fund, but employers were given the option to choose a private insurance carrier to provide coverage, instead of the FAMLI Division. Employers that chose an approved carrier by Oct. 31 of 2023 are getting refunds on the premiums they’d paid the FAMLI Division earlier in the year.

 

All employers that met the requirements and the deadline are hearing directly from FAMLI on getting those refunds. Now it’s time for those employers to make sure they finish the job and get any employee contributions back to any workers who paid premiums as well. 

 

If you’re an employer in this refund category, here’s what you need to know about getting refunds to your employees:

  • You’ll need to refund current employees who also paid FAMLI premiums last year within 60 days.
  • For former employees who worked for you in 2023 (and paid FAMLI premiums) but no longer work for you, you must try to refund their FAMLI contributions as soon as practicable. If you can’t find a former employee who is due a refund, you need to make those funds available as unclaimed property through the Department of Treasury. 
  • You’ll need to send the FAMLI Division written confirmation of these employee refunds using the template we sent you.
